Monday evening at 6:00 p.m. an innocent, 41 year old bicyclist was struck while riding his bicycle east on San Joaquin Hills Road, near Spyglass Road by a white Volkswagen Jetta. The bicycle rider was pronounced dead at the scene of the crash after paramedics attempted to resuscitate him. The driver of the injury causing Jetta, Danae Marie Miller age 22, is now suspected of driving under the influence at the time of the collision. Miller was driving west on San Joaquin Hills Road when she struck the bicyclist. Miller was arrested at the scene on suspicion of gross vehicular manslaughter while intoxicated and booked in the county jail, according to the Newport Beach Police Department. She was released the next day after posting bail.

Miller has received eleven prior citations, with five for speeding, one for talking on a cell phone, failure to stop, driving against traffic on a one way street, following too close and making an unsafe turn. She was due in court in Santa Ana Thursday for talking on a cell phone while driving. The bicycle accident lawyer at Ehline Law Firm, Southern California’s recognized Santa Monica bicycle accident attorney is also a Newport Beach bicycle lawyer and knows the area where the injury occurred well. The public needs to understand that this type of bicycle crash is most likely a wrongful death, assuming it was caused due to the negligent, or malicious act of driving and killing someone while drunk, which is compensable in court, or via a settlement with an insurance company.

The issue here is whether or not the surviving family of the bicyclist can recover money damages for things like funeral expenses, and/or loss of love and affection, loss of support, etc. With a record like the defendant’s, it appears there may be no insurance or even assets for that matter. But if there is insurance, it may only be a $15,000.00/$30,000.00 policy.

What the consumer needs to remember is that you cannot count on most evil doers to do the right thing by carrying adequate insurance. And adequate insurance in my opinion, is at least a half million in liability coverage. At least with that money, the survivors could pay the funeral and perhaps set up a small annuity.

Now, the family will have to hope for some kind of other coverages, such as a trust, or life insurance. The defendant, if convicted, will likely be bankrupt by time of sentencing. These are the things consumers must know before they ride their bike.
